Muruianu severely reprimanded

The Council passed its decision on March 9 after about one hour of deliberation. The disciplinary procedure was initiated at the suggestion of three members of the Council - Alexandru Arseni, Dumitru Visternicean and Nichifor Corochii - after Ion Muruianu, at the February 13 general assembly of judges, labeled the journalists 'rabid dogs that become dangerous for the society' and said the mass media 'advertise' lawyers who relate cases lost by Moldova at the European Court of Human Rights. Alexandru Arseni proposed discharging Ion Muruianu from the post of judge.
The three members who suggested initiating the disciplinary procedure against Muruianu could not take part in the deliberations as the regulations of the Supreme Council of Magistrates do not allow it. Before the deliberations, Ion Muruianu filed an application, asking that Minister of Justice Alexandru Tanase, who is the ex officio member of the Council, be not allowed to participate in them as he was influenced by Prime Minister Vlad Filat, who is also the leader of the Liberal Democratic Party of which Tanase is a member. The Council rejected yet the application.
Before the decision was pronounced, Muruianu stressed he committed no disciplinary deviation. "The disciplinary procedure is not based on fact and should be stopped," Ion Muruianu said. He reiterated he regrets the words he used to describe the journalists, but underlined he had the right as the mass media denigrate him and other judges.
Ion Muruianu can appeal the Council's decision, but he said he will not do it yet. He said he was a good judge and is considered so by many people.
As Ion Muruianu is not president of the Supreme Court of Justice anymore, he does not form part of the Supreme Council of Magistrates. The Council is to name an acting president of the Court.
